OVERVIEW
This Domain Registration Agreement (“Agreement”) is entered into by and between Aveshost (“Registrar,” “we,” “us,” or “our”) and you (“Registrant,” “you,” or “your”) and sets forth the terms and conditions governing the registration, renewal, transfer, management, and use of domain names registered through Aveshost.
By registering, renewing, or transferring a domain name through Aveshost, you acknowledge that you have read, understood, and agree to be bound by this Agreement, as well as all applicable ICANN policies, registry operator rules, and applicable laws.
1. Definitions
- "Registrar" – Aveshost or its accredited partners authorized by ICANN or relevant country code Top-Level Domain (ccTLD) registries to register domain names.
- "Registry" – The operator responsible for maintaining the authoritative database of domain names for a specific TLD.
- "Registrant" – The individual or entity holding the rights to a domain name.
- "WHOIS" – The public database service that displays registrant contact details, subject to privacy/proxy services and applicable laws.
- "UDRP" – Uniform Domain-Name Dispute-Resolution Policy established by ICANN.
- "DRP" – Dispute Resolution Policies adopted by specific ccTLDs.
2. Domain Registration Services
2.1. Registration Process
- Domain names are allocated strictly on a first-come, first-served basis and are not guaranteed until confirmed by the relevant registry.
- Successful registration is subject to:
- Availability of the requested domain name.
- Compliance with the specific registry rules and policies for the chosen TLD.
- Submission of accurate, current, and complete information as required under ICANN and/or registry rules.
- You acknowledge that submitting a registration request does not guarantee domain ownership until:
- Payment is successfully processed.
- The registry confirms the registration.
- Aveshost is not responsible for delays, rejections, or failures caused by:
- Registry systems.
- Technical errors.
2.2. Registry & ICANN Compliance
- All domain registrations are subject to the rules, policies, and agreements established by:
- ICANN (for gTLDs).
- Relevant national registries (for ccTLDs).
- This includes, but is not limited to:
- ICANN Registrar Accreditation Agreement (RAA).
- Uniform Domain-Name Dispute Resolution Policy (UDRP).
- Uniform Rapid Suspension (URS) procedures.
- Inter-Registrar Transfer Policy (IRTP).
- Expired Registration Recovery Policy (ERRP).
- WHOIS Accuracy Program Specification (WAPS).
- For ccTLDs (e.g., .gh, .ng, .uk, .za, .ca), additional requirements may apply, such as:
- Local presence/residency requirements.
- Proof of business registration or incorporation.
- Specific documentation (e.g., for .gh or .bet domains).
- By registering a domain, you agree to be bound by the relevant registry's rules, in addition to this Agreement.
3. Registrant Obligations
3.1. Accurate Information
- You agree to provide and maintain accurate, current, and complete registration information, including but not limited to:
- Full legal name (individual or business).
- Physical postal address.
- Email address and telephone number.
- Details of administrative, technical, and billing contacts.
- For restricted or regulated domains (e.g., .bet, .gh), you may be required to submit additional documentation, such as:
- Government-issued ID.
- Business registration certificate.
3.2. WHOIS Accuracy & Verification
- You are responsible for ensuring that all WHOIS data associated with your domain(s) is accurate and up to date at all times.
- Failure to maintain accurate WHOIS information may result in:
- Suspension or cancellation of the domain name.
- Refusal of future registrations.
- Providing false, misleading, or incomplete information may be considered a material breach of this Agreement.
3.3. Compliance with Laws & Acceptable Use
- You agree not to use your domain name for any illegal, abusive, or fraudulent activities, including but not limited to:
- Phishing, spamming, or malware distribution.
- Hosting or distributing child sexual abuse material (CSAM).
- Intellectual property infringement (e.g., cybersquatting, trademark abuse, copyright violations).
- Fraudulent financial activities (e.g., fake investment schemes, advance fee fraud, unauthorized gambling).
- Promotion of violence, terrorism, or hate speech.
- Aveshost reserves the right, at its sole discretion, to:
- Suspend or cancel domains involved in such activities.
- Report violations to law enforcement agencies, ICANN, and the relevant registry.
4. Use of Domain Name
- You are solely responsible for the content, services, and activities hosted or operated under your domain name.
- Use of your domain must comply with:
- Aveshost's Acceptable Use Policy (AUP).
- ICANN policies and registry requirements.
- Domains must not be used for:
- Hosting or distributing illegal or infringing content.
- Engaging in spam, phishing, or malware distribution.
- Activities that violate intellectual property rights (e.g., cybersquatting, trademark abuse).
- Aveshost reserves the right to suspend, lock, or cancel any domain found to be in violation of these requirements, without liability or prior notice, where necessary to protect the integrity of our Services, comply with legal obligations, or prevent harm to third parties.
5. Domain Renewals & Expirations
- Domain registrations are time-limited and must be renewed before expiration to maintain ownership.
- In accordance with ICANN's Expired Registration Recovery Policy (ERRP):
- Renewal reminders will be sent at least 30 days and 7 days prior to expiration.
- Additional reminders may be provided after expiration, as required.
- If renewal is not completed before expiration, your domain may enter the following phases (as defined by the registry):
- Grace Period (typically 0–30 days, depending on TLD) – You may still renew at the standard renewal fee.
- Redemption Period (typically 30 days) – The domain may still be recovered, but additional redemption fees will apply.
- Pending Delete – After the redemption period expires, the domain is scheduled for permanent deletion and may become available for public registration again.
- Aveshost is not responsible for loss of domain names due to your failure to renew in a timely manner.
- Auto-Renewal: Where available, you may enable automatic renewal to ensure continued ownership. It is your responsibility to maintain valid payment information.
6. Transfers
- Transfers between registrars are governed by ICANN's Inter-Registrar Transfer Policy (IRTP).
- To transfer your domain:
- You must provide a valid Auth/EPP code.
- The domain must be unlocked by the current registrar.
- Transfers may be denied under the following conditions:
- The domain is less than 60 days old from initial registration.
- The domain was transferred within the last 60 days.
- The domain is subject to an administrative, legal, or payment dispute.
- The domain has a registry lock or court/ICANN/registry order preventing transfer.
- Aveshost will comply with all ICANN-mandated transfer rules and provide reasonable assistance to facilitate valid transfers.
7. Privacy & Data Protection
- In connection with domain registration, we are required to collect and share personal data with:
- Registry operators (for the relevant TLD).
- ICANN (as part of contractual obligations).
- WHOIS databases (subject to privacy/proxy protections and applicable laws).
- Personal data collected includes, but is not limited to: name, email, phone number, and address of registrants and contacts.
- Domain Privacy/Proxy Services:
- Where available, you may enable Aveshost's free privacy protection to mask your WHOIS data.
- Note: Certain TLDs or jurisdictions do not permit WHOIS masking.
- Aveshost processes registrant data in compliance with:
- General Data Protection Regulation (GDPR).
- California Consumer Privacy Act (CCPA).
- Other applicable local and international privacy laws.
8. Domain Disputes
- You agree to submit to dispute resolution procedures under:
- ICANN's Uniform Domain-Name Dispute Resolution Policy (UDRP).
- ICANN's Uniform Rapid Suspension (URS) (for applicable TLDs).
- Relevant ccTLD Dispute Resolution Policies (DRPs).
- Complaints regarding abusive registrations, trademark violations, or cybersquatting may result in:
- Suspension.
- Transfer.
- Cancellation of your domain.
- Aveshost does not mediate disputes between registrants and third parties and shall not be liable for any losses arising from such disputes. Responsibility rests with the registrant to defend their rights in appropriate forums.
9. Suspension & Termination
- Aveshost reserves the right to suspend, lock, transfer, or cancel a domain name where:
- Ordered by a court of law, ICANN, or the relevant registry.
- Registrant WHOIS data is found to be inaccurate or not timely updated.
- The domain is used for abusive, fraudulent, or illegal purposes.
- Non-payment occurs for registration, renewal, or related services.
- Suspension or termination may occur without prior notice where immediate action is required to protect the security and stability of the DNS or to comply with legal/contractual obligations.
10. Limitation of Liability
- Domain registration services are provided strictly on an “as is” and “as available” basis, without warranties of any kind.
- Aveshost, ICANN, registry operators, and related service providers shall not be liable for:
- Loss of domain name due to expiration, non-renewal, or failure to maintain accurate registration data.
- Suspension, transfer, or cancellation of a domain due to disputes, court orders, ICANN/registry policies, or inaccurate WHOIS data.
- Indirect, incidental, special, or consequential damages (including loss of profits, business, or goodwill).
11. Indemnification
- You agree to defend, indemnify, and hold harmless Aveshost, its affiliates, ICANN, registry operators, and service providers, as well as their respective officers, directors, and employees, from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the domain name.
- Infringement of intellectual property rights, trade names, or trademarks by your domain or its associated content.
- Any illegal, abusive, or fraudulent activities conducted via your domain.
12. gTLD vs. ccTLD Registrations
12.1. Generic Top-Level Domains (gTLDs)
- Registrations under .com, .net, .org, .info, .biz, .xyz, .online, and other gTLDs are governed by ICANN policies.
- The following ICANN rules apply to all gTLD registrations:
- Uniform Domain-Name Dispute-Resolution Policy (UDRP).
- Uniform Rapid Suspension (URS).
- Transfer Policy (IRTP).
- WHOIS accuracy obligations and Registrar Accreditation Agreement (RAA).
- Renewal, deletion, grace, and redemption periods for gTLDs follow ICANN-mandated timeframes unless otherwise stated.
12.2. Country-Code Top-Level Domains (ccTLDs)
- Registrations under ccTLDs (e.g., .gh, .ng, .uk, .de, .ca, .us) are governed by the respective national registry and may have policies different from ICANN's.
- Requirements may include:
- Local presence or residency restrictions (e.g., .gh, .ca, .ng).
- Specific documentation (e.g., .bet requires business registration certificates).
- Different renewal or redemption timelines than ICANN gTLDs.
- Local dispute resolution procedures instead of UDRP.
12.3. Conflicts Between Rules
- If there is a conflict between this Agreement and a ccTLD registry's rules, the registry's rules take precedence for that domain.
- For gTLDs, ICANN rules take precedence over this Agreement.
13. Policy Updates
We may update this Agreement to comply with changes in ICANN, registry rules, or laws. Updates will be posted on our website with a “Last Updated” date. Continued use of domains constitutes acceptance.
